Joint Review Panel Exceeds Mandate with Use of Sustainability Framework

The recent joint review panel decision of the Kemess Project illustrates a recent trend toward expanding the role of sustainable development in environmental assessments. By using a sustainability framework to make its decision, the panel exceeded its mandate under existing environmental legislation.

The federal/provincial environmental assessment joint review panel (the Kemess Panel) for the Kemess North Copper-Gold Mine Project (the Kemess Project) released its report on September 17, 2007. The Kemess Panel recommended the rejection of the Kemess Project on the basis that the economic and social benefits of the project, on balance, were outweighed by the “risks of significant adverse environmental, social and cultural effects.”

Texas Court Denies 100 Year-Old Claim to Mineral Interests

Several energy companies recently prevailed in an appeal in a 100-year-old title dispute involving oil and gas interests in south Texas: Longoria v. Exxon Mobil Corp., 2008 WL 227970 (Tex. App. – San Antonio 2008). On January 31, 2008, the San Antonio Court of Appeals affirmed the dismissal by the trial court in Brooks County, Texas of claims by descendants of Jose M. Longoria that they had acquired title to a one-half interest in the mineral estate in 9,200 acres about 100 years ago when Jose M. Longoria allegedly adversely possessed the surface acreage as against his brother, Ponciano Longoria, the ancestor of the current royalty owners. The plaintiffs claimed that the energy companies had wrongfully converted one-half of the oil and gas produced from the 9,200 acres from wells producing on the property during the last 40 years or more.

Texas Supreme Court Makes Key Rulings in Royalty Class Action Litigation

In Bowden v. Phillips Petroleum Company, decided February 15, 2008, the Texas Supreme Court made several significant rulings affecting royalty owner class action litigation.

The Court reaffirmed its prior holdings that class actions are subject to normal rules of res judicata. For suits based on oil and gas leases, the Court wrote: “If the class representatives do not assert at the trial court all claims for damages arising from the leases which could have been litigated before the trial court, the unasserted claims may be precluded by res judicata in subsequent litigation.”

Exxon Freezes Venezuela's Assets in Multiple Countries in Response to Nationalization of Oil Industry

A federal court in New York recently confirmed an attachment order in favor of Exxon Mobil freezing over $300 million in Venezuelan assets. The latest court decision comes on the heels of Exxon freezing over $12 billion in assets of Venezuela’s state-owned oil company, PDVSA, in response to Venezuela’s nationalization of its oil industry.

More States Join California in the Fight Against the EPA's Emissions Ruling

In December of 2007, the EPA denied the state of California’s request for a waiver of the federal Clean Air Act that would allow California to impose regulations that would limit carbon dioxide emissions from new vehicles. California's regulations would significantly cut emissions and require a considerably higher mile-per-gallon average than that of the federal energy bill. The EPA ruled that, under the Clean Air Act, carbon dioxide emissions regulations are within the purview of the federal government. The EPA explained its decision to deny the waiver, in part, by pointing out that allowing some states to regulate emissions would make it more difficult for auto manufacturers to comply with each state’s differing levels of regulation, and explained that the EPA was working on a nationwide solution.

"Hot Gas" Lawsuit to Move Forward

Plaintiff groups in the “hot gas” Multi-District Litigation (“MDL”) will be allowed to proceed with their case after a federal judge in Kansas denied the defendant oil companies’ motion to dismiss for failure to state a claim. The MDL was formed to address the issue of fuel expansion in warm weather. House Passes Renewable Energy Tax Breaks

The House Ways and Means Committee introduced what would become the Renewable Energy and Energy Conservation Tax Act 2008 (H.R. 5351) on February 12, 2008, and the bill passed the House of Representatives on February 27, 2008. The bill proposes granting $17.5 billion in tax breaks for investments in renewable energy and building efficiency. Similar bills have been blocked in the Senate because the tax breaks would be financed through repealing other tax breaks (valued at approximately $13.6 billion) granted to oil and gas companies in 2004 for domestically produced goods.

  The IEL welcomes new Chair and Vice-Chairs of the Advisory Board.
   
 
Tim T. West assumed his new role as Chair of the IEL Advisory Board in February. Tim is currently Associate General Counsel for Devon Energy Corporation, based in Houston, Texas. He has been with Devon for 8 years, before which time he served in senior legal positions with Santa Fe Snyder, BP America and Union Texas Petroleum. He focuses on international law, oil and gas law and transactions. Tim was awarded a bachelor of arts degree from the University of Virginia, a law degree from Rutgers University, where he served on the Law Review, and a masters of business administration degree from Columbia University. He is just completing a term as President of the International Association of Petroleum Negotiators in April and is a Director of the World Affairs Council of Houston. Tim previously served as Chair of the IEL Membership and International Practice Committees.

Tom E. Cook is a new Vice Chair of the Advisory Board’s Executive Committee. Tom is Deputy General Counsel – E&P for ConocoPhillips, based in Houston, Texas. He has been with ConocoPhillips for 19 years. Before moving to Houston in 2004 he managed the legal services for ConocoPhillips in Alaska and then in ConocoPhillips’ Europe, Russia & Caspian Regions from London. Tom has had several long-term assignments outside the United States and has considerable experience in complex litigation and advising on major upstream and downstream transactions. Cook was born in Cushing, Oklahoma. He was awarded a Bachelor of Arts degree from Oklahoma State University in 1978 and a Juris Doctorate degree from the University of Oklahoma in 1987. He is past Chair of the Institute's Law of LNG Conference.
   
 
J. Alan B. Dunlop is also a new Vice Chair of the Advisory Board. Alan is currently the Vice President and General Counsel, Worldwide Exploration & Production, for Hess Corporation. He qualified as a solicitor in Scotland in 1985, England and Wales in 1992, and as an attorney in New York in 2002. He joined Hess Corporation (then Amerada Hess) from private practice in 1992 and has since supported all aspects of the business. He is responsible for the management of all legal business in the corporation’s E&P Division, and has lawyers in Houston, London, Kuala Lumpur and Jakarta. Alan formerly served as Chair of the IEL’s International Practice Committee.

Lawrence P. Simon, Jr. is also a new Vice Chair of the Advisory Board. As a shareholder at Liskow & Lewis, in Lafayette, Louisiana, his practice emphasizes oil and gas royalty and other mineral lease issues, energy marketing contract disputes and cases involving the processing of natural gas and the contracts affecting these operations. Prior to his law career, Larry served in the U.S. Army Reserve and attended the U.S. Army Intelligence School at Ft. Holabird. He received a theology degree from the Catholic University of Louvain in Belgium, a bachelor of arts degree from the Notre Dame Seminary in 1965, and his law degree from Tulane University in 1972, where he served on the Tulane Law Review. Larry is a past Chair of the IEL's Oil and Gas Practice Committee and the annual Oil and Gas Law Conference.
   
   
   
 

New Committee Created For Young Energy Professionals

The Institute for Energy Law (“IEL”) values the involvement of its younger members and wants to encourage more to join and participate. To help accomplish these goals, the IEL recently created a Young Energy Professionals (YEP) Committee, which has a seat on IEL's Executive Committee. Laney Vazquez, an attorney with BP, is the YEP Committee Chair. Steve Otillar, a Partner with Baker & McKenzie LLP, is Vice Chair.

To kick off the establishment of this new committee, the IEL hosted a Young Energy Professionals Networking Breakfast as part of the 59th Annual Oil and Gas Law Conference in February. Over 60 YEPs attended the successful event (we carded at the door to keep the "seasoned" professionals out), and many YEPs stayed for the rest of the Conference for both the excellent educational sessions and the opportunities to network with the larger IEL membership. The YEP Committee is currently planning this year's programs and events and would appreciate your input. Activities being considered are a YEP webpage and list serve, a mentoring program, a general counsel panel discussion and luncheon, happy hours, wine-tastings and dinners.
