Oil and Gas in Mexico: Recent Amendments in the Energy Sector

After a review by Mexico's Congress of several legislative proposals made by President Felipe de Jesús Calderón Hinojosa and several political parties to amend and enact new laws dealing with the energy sector, on November 28, 2008, energy reforms were published in the Federal Official Gazette and entered into force on November 29, 2008. The constant low level of oil extraction and production, as well as decreasing market prices, contributed to motivating Congress to approve the series of legislative proposals that will give PEMEX tools to be more efficient.

Proposed Changes to the False Claims Act Could Energize the Plaintiffs' Bar

Under the Federal Civil False Claims Act, persons or entities who deceive the federal government to improperly obtain from (or improperly be relieved from paying to) the government can be liable for up to three times actual damages suffered plus mandatory civil penalties. 31 U.S.C. §§ 3729-3733. Included in the Act are qui tam provisions that allow private whistle-blowers, or "relators," to bring these lawsuits on behalf of the federal government and to share in up to 30% of the recovery. 31 U.S.C. § 3730(b). Could proposed changes to this legislation encourage new litigation?

Energy Provisions of the American Recovery and Reinvestment Act of 2009

On February 17, 2009, The Energy Law Advisor published an E-Lert authored by Aaron Ball discussing the American Recovery and Reinvestment Act of 2009 ("ARRA") which was signed by President Obama that day at an alternative energy facility outside of Denver, Colorado. This article provides a more comprehensive discussion of the ARRA, the largest single domestic spending program in U.S. history which includes billions of dollars in tax incentives and spending for energy programs.

Young Energy Professionals Wine Tasting Reception

IEL’s Young Energy Professionals committee (YEP) hosted a successful wine tasting event at the 60th Annual Oil & Gas Law Conference on February 20, 2009 at the Hilton Post Oak in Houston. The promise of wine and great conversation kept about 75 conference-goers after the conference on Friday afternoon. Keeping with the educational theme of the conference, the event began with a tasting presentation by three sommeliers (Manuel Cuevas, John Yeager and Ashley Bobbett) and was followed by a blind wine tasting. While we sampled tasty cheeses and sipped wines that had their labels covered, each attendee used a voting card to guess the wine’s varietal, vintage, house and price point. For those that attended, we had Chardonnay, Pinot Noir, Merlot, and Cabernet Sauvignon. We had multiple contestants who had perfect scores, so by a random drawing Stephanie Kinzel of Fulbright & Jaworski will receive a free bottle of wine!

The attendees also guessed what the price of oil per barrel would be at the time of the Annual Oil & Gas Law Conference in 2010! We will announce the results at next year’s conference.

For our next event, we will be co-hosting a 'Careers in International Energy' event at the Petroleum Club of Houston from 6:30 to 8:00 p.m., Tuesday, April 21st. This dinner program will feature a panel of energy executives discussing their careers with an audience of aspiring young professionals. At the start of the program, panelists will be introduced on stage by the emcee. Then they will join the audience and spend 15 minutes at four different tables for direct discussion with attendees. The expected attendance is 200 young professionals from: the Institute for Energy Law YEP group, the World Affairs Council YPG, Society of Petroleum Engineers YPG, and the Petroleum Club Young Professionals Association.
