El Moot ha tenido un papel protagónico en el desarrollo del arbitraje en el Paraguay. Así, por ejemplo, las competencias internacionales de Arbitraje o “Moots” han servido de semillero de las actuales mentes más brillantes en lo que se refiere a la práctica arbitral de nuestro país.

El Moot también ha servido para elevar el nivel de la práctica arbitral en el Paraguay. Así, es fácil distinguir un arbitraje en el que participan ex-Mooties, ya sea como abogado de parte o como árbitro, de uno en el que no.

Es por ello que en esta actividad convocamos a los ex-Mooties más sobresalientes, tanto de la Universidad Nacional de Asunción como de la Universidad Católica, para discutir sobre el estado actual del arbitraje, ya que, si bien se ha logrado mucho a lo largo de los años, todavía hay mucho que mejorar.

Este es el espacio de los ex-Mooties. Ellos tienen la palabra.

Bajo la moderación del Dr. José Antonio Moreno Rodríguez se generará un rico debate entre los ex-Mooties acerca de diversos temas propios de la práctica arbitral, como, por ejemplo:

  • Buenas y malas prácticas arbitrales
  • Desde cuándo inicia el arbitraje
  • Contenido de la solicitud de arbitraje
  • Conveniencia de un calendario procesal
  • Cartas, órdenes procesales y laudos: cuándo proceden cada una de ellas. No debería haber "providencias" en los arbitrajes
  • Práctica de prueba y las reglas IBA
  • Medidas cautelares
  • Periciales y testificales - particularidades de ambas en los arbitrajes
  • Las disidencias u opiniones separadas: no forman parte del laudo. Consideraciones varias
  • Problemas de constitucionalidad en el arbitraje
  • Cuándo se pueden anular los laudos. Qué pasa cuándo se anulan los laudos
  • Problemas selectos de arbitrabilidad: corrupción, Ley 194, etc.
  • Problemas de la ley paraguaya para la ejecución de laudos

En síntesis, se trata de una iniciativa con la que se busca generar un espacio que propicie un genuino debate entre quienes han tenido y siguen teniendo un rol importantísimo en el arbitraje de nuestro país: los ex-Mooties.

The mission of the Americas Initiative is to enrich knowledge, debate, and personal relationships within the international arbitration community in the Americas. Americas Initiative has created a network of Country Delegates to represent it in different American countries.

Thanks to the generosity of our County Delegate, this event is tuition-free and includes drinks and hors d’oeuvres. Registration is required to attend.


The Moot Competitions have played a leading role in the development of arbitration in Paraguay. Thus, for example, they have served as a seedbed of the current most brilliant minds in terms of arbitration practice in our country.

The Moot has also served to raise the level of arbitration practice in Paraguay. Thus, it is easy to distinguish an arbitration in which ex-Mooties participate, either as counsel or arbitrator, from one in which they do not.

That is why we will invite the most outstanding ex-Mooties, both from the National University of Asunción and the Catholic University, to discuss the current state of arbitration in our country, since, although much has been achieved over the years, there is still much to improve.

This is the space for ex-Mooties. Here, they have the floor.

Under the moderation of Dr. José Antonio Moreno Rodríguez, a rich debate will be generated among the ex-Mooties on various topics of arbitration practice, such as:

  • Good and bad practices in arbitration
  • When does arbitration begin?
  • Content of the Request for Arbitration
  • Why a procedural timetable is appropriate?
  • Letters, procedural orders and awards: when each of them proceeds. 
  • IBA rules on the practice of evidence
  • Precautionary measures
  • Expert and witness testimony - particularities of both
  • Dissents or separate opinions: not part of the award
  • Issues of constitutionality in arbitration
  • When awards can be set aside. What Happens When Awards Are Set Aside
  • Selected issues of arbitrability: corruption, Law 194, etc.
  • Problems of Paraguayan law for the enforcement of awards

In short, this initiative seeks to generate a space that fosters a genuine debate among those who have had and continue to have a very important role in the arbitration of our country: ex-Mooties.

En este espacio se iniciará un debate abierto sobre los distintos temas relacionados a la práctica arbitral. El espacio estará dirigido por el Dr. José Antonio Moreno Rodríguez. / An open debate will be held on the different topics related to arbitration practice. The dynamic will be led by Dr. José Antonio Moreno Rodríguez.
