Overview

IEL’s 73rd Annual Energy Law Conference will be held in-person in Houston, while also being available as a livestreamed event to online registrants.  Individuals must choose to attend the conference either in-person or online.

As the world’s long running energy law conference, the 73rd Annual Energy Law Conference will bring together legal leaders and other professionals in the energy industry for two days of excellent educational programming covering the oil, gas, and renewables sectors of the energy industry. Attended by in-house leaders, experienced energy attorneys in private practice, government attorneys, landmen, non-legal energy professionals, and young energy professionals, this conference also provides opportunities for social and professional networking with distinguished and diverse attendees.

The conference is free for all IEL Advisory Board Members.

Airport

Although Houston has two major airports, the George Bush Intercontinental Airport (IAH) is much closer to the conference hotel and will not require sitting in traffic (8 miles compared to the 29 miles to Houston Hobby which is on the other side of Downtown Houston).

IEL Distinguished Leadership in Energy Award Recipient

Linda Z. Cook
Chief Executive Officer
Harbour Energy plc

Linda Z. Cook was named Chief Executive Officer (CEO) of Harbour Energy plc on 1 April 2021. Prior to this, Linda was Chairman of the Board of Chrysaor Holdings Ltd, and a member of the Investment and Executive Committees of EIG Global Energy Partners (EIG), positions she held since 2014. She retired from Royal Dutch Shell plc in 2010, at which time she was a member of the Board of Directors and the Executive Committee. During her 29 years with Shell, she held positions including CEO of Shell Gas and Power (London); CEO of Shell Canada Limited (Calgary); Executive Vice President Strategy and Finance for Global Exploration and Production (The Hague); and various US exploration and production management, operational and engineering roles. She remains an advisor to EIG and is currently a Trustee for the University of Kansas Endowment Association, a member of the Society of Petroleum Engineers, and a Non-Executive Director on the Board of BNY Melon. She received a B.S. degree in Petroleum Engineering from the University of Kansas in 1980.

COVID Warning and Protocols

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and individuals with underlying medical conditions are especially vulnerable. By attending the 73rd Annual Energy Law Conference, you voluntarily assume all risks related to exposure to COVID-19 while at the Conference.

All attendees are encouraged to be fully vaccinated prior to attending the conference.  You will be required to submit evidence to IEL that you are fully vaccinated prior to the conference or provide a negative COVID test taken within 72 hours of the start of the conference.

Given the current state of infection for COVID, masks are required to be worn by attendees while interacting with IEL staff, while in designated common areas such as meal and refreshment lines, and while walking or standing in designated common areas, including the conference rooms and designated areas of the hotel atrium/foyer near the conference rooms. Although not required while seated in the conference rooms or while actively eating or drinking, we strongly encourage masks be worn at all times.  In addition, we request that attendees respect others, including wearing a mask or moving to a different seat in the conference room if a person prefers that a mask be worn.

Aftermath of the McGirt Decision – What You Need to Know

In July 2020, the United States Supreme Court decided that an Indian reservation in Oklahoma was not disestablished at the time of statehood. Shortly thereafter, Oklahoma Courts expanded that decision to include the reservations of five other tribes. The result? Nearly 43% of Oklahoma’s land mass is now considered Indian Country. In this presentation, GableGotwals’s Trent Shores, a former United States Attorney, and Dean Luthey, chair of the Firm’s Native American Law section and a senior trial lawyer, will discuss the impact of the Supreme Court’s McGirt decision on criminal and civil jurisdiction in Eastern Oklahoma. From unique considerations for the energy industry to working with tribal governments, the McGirt decision presents both opportunities and questions for oil and gas entities.

Hook, Line & Sinker – Litigation Nightmares Arising When My Vessel’s Anchor Ruptures Your Subsea Pipeline

As the number of vessels anchored off US ports grows exponentially and in light of the recent California pipeline spill, the risk of a vessel dragging her anchor and striking a subsea pipeline has come into focus once again. This session will explore key considerations that arise in such litigation, including identifying and obtaining jurisdiction over the offending vessel and her owners, determining the appropriate venue and applicable law, applicability of presumptions of fault in such cases and strategies to overcome such presumptions, damage issues, and other related considerations.

Jones Act Compliance Amidst Developing Offshore Technologies and Transportation Support for Alternative-Energy Initiatives

As the search for alternative and cleaner-energy sources continues, new technologies abound in the arenas of energy production and advancements in the modes of transportation used to support novel forms of energy capture. With the development of offshore wind farms and other near-coastal energy installations, as well as larger and more complex exploration facilities in deeper waters, comes the ever-increasing complexities of servicing the energy-manufacturing market in compliance with existing and aging laws. The Jones Act provides a framework of regulations to govern the coastwise trade of the United States. This presentation will focus on the current relevance of the Act and examine the ways in which its verbiage and proper interpretation may just permit options for offshore-operational harmony between both domestic and foreign flag vessels as they work together to support an industry striving to achieve energy alternatives.

Human Rights Claims and Counterclaims in International Energy Arbitration

Recent high profile energy arbitrations raise the specter of significant human rights counterclaims in investment arbitrations. Such claims, however, need not be limited to investment arbitration. Claims or counterclaims sounding in human rights violations could conceivably be raised in commercial arbitration proceedings, particularly if the human rights claims are raised in the context of allegations of violation of environmental obligations of project sponsors. Similarly, energy companies may well rely upon human rights jurisprudence to make claims concerning alleged egregious governmental misconduct. This panel will address the opportunities and challenges of such claims and counterclaims and how these claims overlap with ongoing ESG efforts on the transactional side.

Visa Information

If you require a letter of invitation to obtain a visa for this conference, payment of the registration fee must first be made.  If you apply and do not receive a visa, please send us a copy of the rejection letter from the consulate, and we will cancel your registration and issue a refund.
