Overview
Traditional data privacy litigation is being supplanted by increasingly complex claims focused on particular kinds of data, like biometrics; tracking and analytical tools like pixels; and old laws like the Video Protection Act and state wiretap that are being repurposed for the online world. Many of these claims are based on state laws that carry statutory damages for violations that may lend themselves to class actions and are enforceable by private plaintiffs in some cases, and state Attorneys General in others. In this environment, the risks of privacy litigation and government are increasing exponentially, as evidenced by a $220 million verdict against a defendant in an Illinois Biometric Information Privacy Act trial and a billion dollar settlement reached with the Texas Attorney General under its Capture Or Use Of Biometric Identifier Act.
The webinar will cover the following specific topics:
- Biometric data privacy claims under statutes including the Illinois Biometric Information Privacy Act, Washington’s My Health My Data Act, and Texas Capture Or Use Of Biometric Identifier Act.
- The Federal Trade Commission’s recent guidance on biometric information.
- Video Privacy Protection Act claims
- Claims under wiretap statutes including California’s Invasion of Privacy Act, Florida’s Security of Communications Act and Pennsylvania’s Wiretapping and Electronic Surveillance Control Act

Chris Fredrich

Chris Fredrich focuses his practice on complex civil litigation, with an emphasis in defending financial institutions and other commercial clients in class actions, arbitration, and enforcement matters.
As a litigator, Chris represents banks, digital payment companies, credit card issuers, loan servicers, investors, and technology companies in state and federal court proceedings, at both the trial and appellate levels. He has significant experience litigating claims under banking, privacy and consumer protection laws, including the Electronic Fund Transfer Act, Truth in Lending Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act and Telephone Consumer Protection Act, as well as California’s Unfair Competition Law, False Advertising Law, Consumers Legal Remedies Act and Invasion of Privacy Act. Chris has successfully defended multiple actions alleging violations of the Uniform Commercial Code and state-law contract and tort theories.
Chris also has significant experience advising clients in regulatory and compliance matters. This includes conducting comprehensive internal procedure reviews, assessing risk in connection with institutional investment opportunities, and counseling clients on privacy and data breach notification issues. In addition, Chris represents clients in responding to state and federal regulator inquiries and enforcement actions.

Jennifer Quinn-Barabanov

Jennifer Quinn-Barabanov is the co-leader of Steptoe's Commercial Litigation Group. She focuses on high-stakes, high-profile commercial and class action disputes. Jennifer achieves successful results by implementing purposeful, pragmatic and creative strategies developed through continuous communication and collaboration with her clients.
As leader of the firm's Energy Litigation practice, Jennifer regularly represents public utilities, pipelines, and other energy companies in commercial disputes. She has particular experience navigating the intersection of business disputes with regulatory obligations and tariffs.
In addition, Jennifer leads Steptoe's Class Action practice. She is a recognized leader on class certification issues who has successfully defended companies in the technology, consumer products, retail and other industries. Jennifer has defeated numerous proposed class actions, including several after lengthy evidentiary certification hearings. Jennifer has particular experience with statutory damage privacy-related class actions, including those brought under Illinois' Biometric Information Privacy Act and the federal Video Privacy Protection Act.
A skilled litigator, Jennifer has substantial experience handling commercial disputes in areas such as: antitrust, breach of contract, business torts, fraud, fiduciary duty and derivative claims, covenants not to compete, trade secrets, and claims under the federal securities laws and Racketeer Influenced and Corrupt Organizations (RICO) Act.
As the former co-chair of Steptoe's Women's Forum, Jennifer organized a variety of programs to cultivate the unique perspectives of the firm's women lawyers and professionals.
