Please join us for the fourth webinar of the Young ITA Mentorship Program – Speaker Series: The (Sometimes Forgotten) Importance of the Arts and Psychology in Advocacy in International Arbitration. This program will showcase eminent international arbitration thinkers and practitioners discussing the latest developments in international arbitration. The topics will be tailored towards Young ITA mentees, a diverse group of students and early career arbitration professionals from around the world that are interested in international relations and trade including international dispute resolution. In addition, speakers will dedicate a portion of each talk to careers in arbitration.

#YoungITATalks is a series of local events presented around the world, featuring talks, workshops or interviews that cover a wide range of subjects relating to arbitration. The #YoungITATalks series is designed for education, conversation and sharing knowledge and experiences among young practitioners.

The (Sometimes Forgotten) Importance of the Arts and Psychology in Advocacy in International Arbitration

The art of persuasion requires more than solid legal arguments and mastery of evidentiary rules. Much like actresses and actors on stage, arbitration lawyers perform and tell stories. Geared towards enhancing the advocacy skills of Young ITA members and budding arbitration practitioners, this program will examine the performative aspects of arbitration lawyering. Under the moderation of Mr. Mori, Mr. Bullard and Prof. Nappert will explore the use of the arts and psychology as tools in arbitration advocacy and the extent to which, if at all, theatre methods and psychological factors influence the decision-making processes of arbitrators. Attendees will get the chance to ask questions from the speakers who have done extensive interdisciplinary work and research on arbitration, theatre, and psychology.

Mr. Alfredro Bullard is an ICSID arbitrator, Member of the ICC International Court of Arbitration, professor of international arbitration and advocacy, and thespian enthusiast. He has also been counsel in more than 100 arbitration cases, including cases administered by the ICC and ICSID. He holds professorial positions in several universities, including Pontificia Universidad Católica del Perú where he teaches a course on advocacy in international arbitration applying theatre techniques. Mr. Bullard is also part of the Law & Arts Committee of the same school and is the playwright of Shylock’s Appeal, a play which portrays the appeal proceeding of Shylock, the main character in Shakespeare’s The Merchant of Venice. Mr. Bullard will speak about the use of the arts and theatre techniques in arbitration advocacy.

Sophie Nappert is a London-based, full-time arbitrator in independent practice, a university lecturer of international investment law and arbitration, and pioneering author on interdisciplinary topics of technology, psychology, and arbitration. Prof. Nappert is an award-winning lecturer and the first female recipient of the Global Arbitration Review Award for Best Speech in 2016 for her Inaugural EFILA Annual Lecture on International Investment Arbitration: Escaping from Freedom? The Dilemma of an Improved ISDS. She also created the Nappert Prize in International Arbitration, open to young scholars and practitioners worldwide, administered under the auspices of McGill University. In the field of advocacy and psychology, she co-authored Psychological Factors in the Arbitral Process in 2010 and delivered an address on The Psychology of Persuasion in International Arbitration at Dubai Arbitration Week in 2018. Prof. Nappert will discuss the impact of psychological factors in the arbitral process.
