Over recent weeks, the world has witnessed a dramatic escalation of economic sanctions in response Russia’s unlawful invasion of Ukraine. Sanctions have an impact not only on economic activity but also on the resolution of cross-border disputes, primarily through international arbitration. This includes giving rise to a new source for commercial and investment disputes, creating impediments to the arbitral process, and raising questions about the treatment of arbitral awards in domestic courts.

You are invited to a live webinar featuring a panel discussion on this important and timely topic. Our panelists will consider the effect of sanctions on international arbitration from the practitioner’s perspective, and explore how parties, tribunals and arbitral institutions have approached these issues in the past.

About the Presenters

Nicola Swan
Chapman Tripp

Nicola Swan is a partner in Chapman Tripp’s Litigation & Dispute Resolution team and leads the firm's international law practice. Based in Wellington, she also leads the firm’s sanctions and international trade practices. Nicola focuses on international and domestic commercial arbitration and litigation, public international law, public law and climate risk. Nicola is recognized as a “Future Leader” by Who’s Who Legal: Arbitration for 2021. She also has particular experience in constitutional litigation, the intersection between business and human rights, and disputes engaging both public international law and national courts. She advises clients across a broad range of industries, including in the energy, oil & gas, extractive, private equity and telecommunications sectors.

Katie McDougall
Norton Rose Fulbright

Katie McDougall is a partner at Norton Rose Fulbright in London advising on risk, including dispute resolution and sanctions. Her sanctions practice involves advising clients across all sectors, but particularly in energy, natural resources, financial institutions and transport. Katie assists clients with financial and trade sanctions for all major regimes, including compliance procedures, due diligence, specific transactions and investigations. Her disputes practice covers domestic and international disputes across the energy sector, and in particular oil and gas, power and renewables. Katie's experience covers both court litigation and international arbitration. Katie is qualified to practice in the UK, and is also admitted to practice in the courts of Western Australia and the High Court of Australia.

Dr. Harald Sippel

Dr. Harald Sippel is the founder of sippel.legal, an international boutique firm with a special focus on East Asia and the ASEAN region in particular. Having spent the major part of his career in East Asia and speaking several Asian languages, Dr. Sippel regularly assists companies from the “Western World” with their activities in the Asia-Pacific region, both with their contentious and non-contentious matters. Applying a holistic approach, his advice always includes business, cultural and other relevant considerations. He is the co-editor of Force Majeure and Hardship in the Asia-Pacific Region (2021) and the founder of forcemajeure.world, the world’s first website dedicated to legal and practical matters of force majeure, including a tailor-made force majeure clause builder. He publishes on force majeure and hardship events, including the impact of sanctions, on a dedicated LinkedIn Group on a daily basis.

Daniel Allman
Norton Rose Fulbright

Daniel Allman is a senior associate at Norton Rose Fulbright in Sydney. Daniel specializes in cross-border dispute resolution and represents clients in international commercial and investment arbitration, as well as complex commercial litigation. He is dual-qualified in Australia and New York. Daniel was previously an associate at Covington & Burling in New York, and has worked as a consultant to a UN agency on business and human rights in Southeast Asia and as a solicitor at another leading firm in Australia and on secondment in China. Daniel received his LL.M. from Columbia University and his LL.B. and B.A. from the University of Melbourne. He served as managing editor of Columbia FDI Perspectives and writes frequently on arbitration, investment, and trade.
