A poco más de 40 años desde la primera concesión de obra pública en Chile, el sistema de concesiones chileno ha tenido importantes cambios. En materia de controversias, la reforma legal introducida el año 2010 cambió sustancialmente el mecanismo de solución de controversias establecido originalmente en la ley. Con el objeto de facilitar la resolución temprana de conflictos, la ley introdujo un Panel Técnico, encargado de emitir recomendaciones no vinculantes respecto de controversias de carácter técnico y económico, como instancia previa al inicio de un procedimiento contencioso entre la respectiva sociedad concesionaria y el Ministerio de Obras Públicas, el que en la gran mayoría de los casos corresponde a un procedimiento arbitral. A más de 10 años de la referida reforma es interesante revisar el impacto que ha tenido, y los desafíos que presenta la solución de controversias en esta industria.
