Overview
The panel discussion, moderated by a member of the NY City's Professional Discipline Committee, will leverage insights from esteemed members of the MENA legal community, to delve into the nuances of ethical compliance in arbitration. Notably, the UAE's recent amendments to its arbitration law (Article 10) signify a burgeoning commitment to ethical standards, a movement that's gaining momentum among prominent arbitrators and legal professionals. The session is set to examine these nascent regulations, scrutinize their implications across the UAE, Saudi Arabia, and the broader region, and engage in a critical dialogue on the formulation of effective compliance frameworks. Key questions include identifying the most suitable ethical codes, understanding the stakeholders affected, and debating the merits of adhering strictly to IBA guidelines versus the adoption of bespoke regional standards.

Ibrahim Ati (moderator): Dual-educated legal professional with training in both civil and common law systems, having passed the New York Bar and obtaining an LL.M. in Alternative Dispute Resolution from the University of Southern California, he is one of the youngest members on the NY City Bar Association's Professional Discipline Committee. Vice-Chair in the American Bar Association’Young Lawyers Division.

Chartered Arbitrator of the Chartered Institute of Arbitrators, a Chartered Facilities Management Surveyor with the Royal Institution of Chartered Surveyors, and a Fellow of the Chartered Institute of Procurement and Supply Chain, Mrs. Fatima Balfaqeeh is also a board member of the ICC-UAE and Vice Chair of the ICC UAE's Commission on Arbitration and ADR Steering Committee.

Dr. Mahmood Hussain: A prominent figure in UAE's legal landscape, Dr. Hussain is also the founding partner of one of the most prominent MENA law firms. Dr. Hussain played a pivotal role in establishing the Dubai International Financial Centre (DIFC) Courts, serving as a key member of the committee that founded the DIFC Courts and later as its inaugural Deputy Registrar. He actively contributed to the development of various legislations for the DIFC courts. Dr. Hussain has been recognized by the DIAC as the most promising arbitrator in the region and currently serves as a board member and vice-chair at the ICC-UAE. His vocal stance on ethical compliance for arbitrators in the region makes him an invaluable addition to our panel.
