El objetivo de este evento es discutir la nueva ley de arbitraje de Costa Rica de una manera atractiva tanto para abogados corporativos como para especialistas en disputas. El evento constará de dos paneles. En el primero, se analizará el impacto que se espera que tenga la nueva ley en el ámbito del derecho corporativo. Esto incluirá una discusión sobre las ventajas que presenta esta normativa para las partes de un arbitraje en comparación con el modelo anterior.

En el segundo panel, se discutirán los cambios que deben implementarse en el arbitraje a partir de la entrada en vigencia de la nueva ley, con el fin de dejar atrás prácticas obsoletas que ya no se ajustan a la nueva normativa. Estas prácticas, en su mayoría de origen judicial, han hecho que el arbitraje se perciba como una especie de litigio modificado. Además, han afectado negativamente la naturaleza flexible y expedita del procedimiento arbitral en comparación con el litigio judicial.

(The goal of this event is to discuss Costa Rica’s new arbitration law in a way that appeals to both corporate lawyers and dispute resolution specialists. The event will feature two panels. The first panel will analyze the expected impact of the new law in the corporate law field, focusing on the advantages it offers the parties compared to the previous model.

The second panel will focus on the changes that need to be implemented in arbitration following the new law’s enactment to phase out outdated practices that no longer align with the new legislation. These practices, primarily originating from the judicial system, have historically made arbitration appear as a modified form of litigation, which has negatively impacted its flexible and expeditious nature compared to judicial litigation.)
