El derecho a la consulta de los pueblos indígenas, previsto en las constituciones modernas latinoamericanas e instrumentos internacionales, si bien implica un importante reconocimiento y protección de los derechos de los pueblos y comunidades indígenas, presenta ciertos retos desde el punto de vista procedimental y de fondo, y a menudo puede entrar en conflicto con el desarrollo de proyectos de infraestructura y con la inversión extranjera.
Por ello, se ha vuelto un aspecto importante para el derecho de las inversiones internacionales y un posible punto de controversia en el arbitraje de inversión, en la medida en que no respetar el derecho a la consulta o bien el resultado de ésta pueda cancelar o retrasar sustancialmente proyectos completos de inversión.
#YoungITATalks es una serie de eventos presentados en todo el mundo, con charlas, talleres o entrevistas que cubren una amplia gama de temas relacionados con el arbitraje.
