In collaboration with Young ITA’s regional chairs for India, join us in Mumbai for Young ITA’s Cross-Examination and Advocacy Workshop, tailored for young arbitration practitioners. The event will focus on enhancing your cross-examination skills through practical exercises and expert-led discussions. The event will feature a panel discussion on the core aspects of persuasive advocacy and successful cross-examination in international arbitration, followed by a hands-on mock cross-examination exercise.

This workshop offers a unique opportunity for arbitration professionals to enhance their skills through interactive exercises and simulations. Participants will also receive feedback and practical guidance from experienced practitioners and advocacy experts, providing valuable, actionable insights to elevate their arbitration practice. The workshop offers an opportunity to refine your skills, receive expert feedback, and deepen your understanding of effective advocacy techniques. Due to the interactive nature of the workshop, participation is restricted to [16-20] participants, who will be divided into teams.

12:30-1:30 pm - Lunch


1:30 – 3:30 pm - Mock cross-examination scenarios

Participants will engage in mock cross-examination scenarios. Five-six brief case study scenarios, each focusing on a particular issue in an expert’s testimony, will be circulated in advance. The panel will briefly explain each scenario, and participants will be asked to:

  • Develop a cross-examination strategy
  • Draft relevant cross-questions for the expert witness
  • Discuss the desired outcomes from the cross-examination.

Each group will present their approach to one of the scenarios, with panelists providing feedback on the strategies, questions, and approaches. The panelists will also offer insights on what worked, what did not, and how to improve cross-examination techniques based on the scenarios.

Speakers

Zal Andhyarujina SA
Barrister, Fountain Court Chambers

Zal Andhyarujina is a prominent Senior Advocate at the Indian Bar, based in Mumbai. He has a large and diverse commercial practice with a focus on cross border disputes. He has appeared in many important commercial disputes. Zal’s areas of expertise include international arbitration, banking, financial services, commercial law, company law, enforcement of foreign awards and decrees and restructuring and insolvency.

He practices in the Bombay High Court, The Supreme Court of India and various tribunals including the Securities Appellate Tribunal (SAT), the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT).

Montek Mayal
Partner and Practice Head for Asia and the Middle East, Osborne Partners

Montek is a Partner and Practice Head for Asia and the Middle East at Osborne Partners, based in New Delhi. Prior to joining Osborne Partners, Montek was a Senior Managing Director in FTI Consulting's Economic and Financial Consulting segment. Whilst there, he was also responsible for building and leading their Indian practice. He previously served on the board of a joint venture with Intel Capital in the field of robotic surgeries in India and also served as the interim CEO for a major travel services company. Montek has been appointed as an expert in domestic and international arbitrations and in competition matters on over 100 occasions, both in India and globally. He has testified before tribunals over 35 times since 2017, on claims ranging from USD 5 million to over USD 1.5 billion. Montek was recognised as a Global Elite Thought Leader in Who's Who Legal's Arbitration Review 'Expert Witnesses' for 2021 and 2022, and as a 'Thought Leader for India' in 2023. Montek is one of 28 practitioners, globally, recognised in this listing who received the highest number of nominations from peers, corporate counsel and other market sources. Montek has also been identified by The International Who's Who of Commercial Arbitration as one of the leading global expert witnesses from 2017 to 2022. He was also listed in Who's Who Legal Consulting Experts Guide from 2016 to 2022 in the 'Quantum of Damages' field.

Poorvi Satija
Senior Associate, White & Case, London

Poorvi Satija is a senior associate in the International Arbitration Group in London and is qualified to practice in England & Wales, the State of New York, and India. She has extensive experience in both international commercial and investment arbitration cases under major institutional rules, including the ICC, LCIA, SIAC, and ICSID Rules.

Poorvi has been actively involved in the Willem C. Vis International Commercial Arbitration Moot competition as an arbitrator and coach for a number of years. She is also a trained mediator and negotiator and has been coaching teams for the IBA-VIAC CDRC Vienna Mediation and Negotiation Competition since 2017.

Poorvi graduated from NALSAR University of Law, Hyderabad in 2013 with several laurels, including the most outstanding student of her class and the Vice Chancellor's Medal for outstanding leadership skills.

She is actively involved in a number of the Firm's pro bono projects, including for the Public International Law & Policy Group (PILPG).

Shreya Jain
Partner, Shardul Amarchand Mangaldas & Co.
Young ITA, India Co-Chair

Shreya is a Partner in the international arbitration practice at Shardul Amarchand Mangaldas, Mumbai. Her experience includes commercial and investor-state arbitration under nearly all major international arbitration rules and seated in a variety of jurisdictions, such as Mumbai, Singapore, London, New York, Washington D.C, Kigali, Abu Dhabi and Stockholm. A graduate of National Law School of India University, Bangalore and Harvard Law School, Shreya is qualified to practice in India and New York and has previously worked in the international arbitration team at Cooley LLP, New York, before returning to India.

Shreya currently serves as a Regional Representative at YIAG (LCIA’s under-40 arm), Assistant Editor (South Asia) at the Kluwer Arbitration Blog, Steering Committee member in the ERA Pledge (India Chapter) and Secretary of the Harvard Club of Mumbai. She also regularly speaks and writes on contemporary issues in international arbitration, dispute resolution and diversity.

Aayushi Singh
Moderator, Young ITA, India Co-Chair

Aayushi Singh is a dispute resolution practitioner based in New Delhi. Aayushi previously worked as a Visiting Foreign Lawyer at WilmerHale, London. Aayushi's experience includes commercial arbitration under SIAC, ICC and DIAC Rules seated in London, Singapore, Zurich, and New Delhi. She pursued the NUS-MIDS Double Degree Programme between the National University of Singapore, Graduate Institute of International and Development Studies and University of Geneva. She is a recipient of a full scholarship for her postgraduate studies by the Aga Khan Development Network. She also received a full scholarship to pursue the Austrian Arbitration Academy offered by the Sommerhochschule, University of Vienna. She presently serves as the Young OGEMID Rapporteur for Asia and is a Steering Committee Member of the Indian Women in International Arbitration. She frequently writes on different themes under arbitration in India and Singapore.

Ayush Banka
Moderator, Senior Consultant, Osborne Partners

Ayush is a Senior Consultant at Osborne Partners, based in Mumbai. Ayush has over seven years of experience in audit, taxation, financial analysis, corporate finance, business strategy as well as valuation and damages analysis.

Ayush joined Osborne Partners in July 2022 and has been working on several matters in relation to valuation, damages analysis and forensic investigations. Prior to this, he worked with a real estate company in a business strategy and project management role. In the past, Ayush has also worked as a consultant in the Economic and Financial Consulting practice of a leading global disputes practice. Ayush holds an MBA in Finance and Strategy from the Indian School of Business, a BCom from the University of Mumbai, and is also a member of The Institute of Chartered Accountants of India.
