Overview
The Joint Conference is presented by The Institute for Transnational Arbitration (ITA), The Institute for Energy Law (IEL) (both subsidiaries of The Center for American and International Law (CAIL)) and The International Court of Arbitration of the International Chamber of Commerce (ICC).
The 1½-day ITA-IEL-ICC Joint Conference is presented annually in Houston with the support of other leading regional and global arbitration organizations. The Joint Conference traditionally includes a year-in-review analysis of key developments in international energy arbitration practice during the preceding year, panels and debates concerning these developments, a Young Arbitrators Roundtable and a variety of social networking activities.

2:50-3:55 pm - Enhancing Dispute Resolution in the Energy Sector Through Conciliation and Mediation
Stakeholders in the energy sector (and, in fact, many other sectors) want less adversarial and more cost- and time-efficient methods to address contractual, regulatory, and cross-border disputes. This panel will explore the growing role of conciliation and mediation as effective alternatives to arbitration in resolving energy-related disputes globally. The discussion will address whether conciliation and mediation foster expedited resolution of disputes and avoid the time and expense associated with a full-blown arbitral process. Panelists will also share strategies for structuring effective conciliation and mediation processes. This will include a discussion of tools to encourage early resolution of disputes. The goal of this panel is for participants to gain insight into how these mechanisms may best be leveraged to resolve energy disputes.

3:55-4:55 pm - Navigating the Shifting Landscape: Regulatory Changes and Energy Policy in the Americas
As regulatory frameworks across the Americas evolve, energy companies face a complex and dynamic landscape. This panel will examine key incoming regulatory changes in the Americas, with a focus on how shifting policies are impacting compliance obligations, permitting processes, and cross-border energy transactions, and present a picture of legal risks and opportunities. Panelists will also discuss potential disputes arising out of the regulatory shifts. The discussion will provide comparative insights into how companies are navigating regulatory uncertainty, mitigating risk, structuring transactions, and managing disputes in a rapidly changing environment. The discussion will focus, in particular, on the U.S., Mexico, Chile, Argentina and Colombia.

This keynote will explore different ways of reacting to guerrilla tactics in arbitration, to include (a) the forfeiting of rights; (b) use of costs orders; and (c) more generally, the recognition or development of a concept of contempt of arbitration, so as to empower tribunals to police their proceedings more effectively than presently seems to be the case.
