International arbitration frequently involves parties from different cultures and/or that speak different languages and often requires more than translating words but legal concepts, procedural expectations, and advocacy across languages and legal cultures. Using real-world cases and firsthand experiences, this practical dialogue will examine how terms and concepts without direct equivalents can shape submissions, witness testimony, evidence, tribunal reasoning, and due process. Counsel and neutrals will trace those challenges through key stages of an arbitration, exploring how legal traditions influence the language of proceedings, witness examination, requests for emergency or equitable relief, tribunal decision-making, and enforcement. Panelists will share concrete strategies for identifying hidden assumptions, preventing linguistic and conceptual misunderstandings, and mitigating cultural gaps without erasing meaningful differences.
