Overview

The webinar will detail the important energy-relevant regulatory and legislative events in the first 100+ days of the Biden Administration. Coverage will include developing regulatory and policy shifts at key government agencies, including FERC, EPA, Department of Energy, Department of Justice, Department of the Interior, and others. Presenters will also discuss relevant legislative developments and executive actions, analyzing what has already happened and what is likely to happen next.

Emil Barth

Mr. Barth’s practice incorporates a broad range of regulatory, infrastructure development, litigation and transactional matters specific to the energy industry, encompassing nearly all aspects of energy regulation. The clients he represents include major electric, natural gas, oil, and renewable energy companies. He has represented clients in connection with energy and environmental matters before the Federal Energy Regulatory Commission (FERC), U.S. Department of Energy, and other federal and state regulatory agencies. He has extensive litigation experience in both federal and state courts, as well as in contested hearings before administrative law judges at FERC.   Mr. Barth also represents clients before the Federal Communications Commission and assists with licensing and auction matters.  He recently assisted a client in securing approval for a submarine cable transaction that was reviewed under the new Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector process.

George Fibbe represents energy clients in complex commercial disputes and regulatory matters. Mr. Fibbe's practice focuses on high-stakes matters across the energy sector, including upstream and midstream oil and gas, LNG, renewables, nuclear, and the power industry. Before joining Baker Botts, Mr. Fibbe served as Deputy General Counsel for Litigation, Regulation & Enforcement for the U.S. Department of Energy, where he was lead counsel for departmental rulemakings and related regulatory and administrative matters, including serving as chair of the Department's deregulatory task force. He was responsible for all civil enforcement matters of the Department and headed the team dedicated to enforcement of energy efficiency standards for manufacturers. Mr. Fibbe also previously served as general counsel of a solar power company, and as head of litigation for the petroleum division of a major international natural resources corporation.

Allison Watkins Mallick

Allison Watkins Mallick advises clients facing complex environmental challenges, focusing on litigation, regulatory advocacy, and compliance counseling. She has particular experience representing companies and industry coalitions in the energy sector. As a regulatory advocate, Allison develops strategies for working with agencies, helps clients participate in state and federal rulemakings, and advises on compliance issues. Allison has litigated cases in state and federal venues across the country, including enforcement actions, toxic tort cases, class actions, and appeals of permits and federal agency rulemakings. She has experience across all environmental media (air, water, and waste) and has particular experience in air-related issues, having defended Clean Air Act enforcement actions and citizen suits, developed plans for compliance with Regional Haze obligations, and drafted comments on over fifty EPA rulemakings under the Clean Air Act.

Jeffrey Oliver

Jeffrey Oliver has extensive experience counseling clients on merger control and competition enforcement matters in Washington D.C. and every other major antitrust jurisdiction in the world.  Mr. Oliver has significant expertise in the oil & gas industry, having successfully counseled energy companies on important transactions and government investigations in numerous jurisdictions.  Clients have including Shell, HollyFrontier, Valero, Magellan, Halliburton, Tallgrass, Enable, Koch, Maersk, Southern Company, Arch Coal and many others.  Mr. Oliver began his career in the FTC’s Mergers III division, which is responsible for merger control in the midstream and downstream sectors.  At Mergers III, Mr. Oliver participated and led investigations into mergers among major MLPs, investigated alleged anticompetitive conduct in the gathering, processing, storage, and pipeline transportation of natural gas and natural gas liquids, and investigated multiple refinery and pipeline acquisitions in varying markets across the United States.

CLE Credit

Texas Course Number 174124374. This course has been approved for Minimum Continuing Legal Education credit by the State Bar of Texas Committee on MCLE in the amount of 1.0 credit hours, of which no credit hours will apply to ethics/professional responsibility credit.

This online program has not been approved for MCLE credit in any other jurisdictions. If requested by attendees, CAIL will request accreditation in California, Louisiana, Oklahoma, New Mexico, Ohio, Pennsylvania and West Virginia. Accreditation has not been sought or approved in these jurisdictions at this time.  MCLE credit will not be requested in any other jurisdiction.

Although attendees may be able to request MCLE credit directly in additional jurisdictions, the rules vary in each jurisdiction. Certain programs, subjects, and formats may not receive credit in certain jurisdictions and there may be specific rules regarding who may earn credit or the maximum number of credit hours that may be earned with specific formats.
