Overview

A panel discussion of the latest enforcement trends and actions by federal and state authorities along with analysis of recent private litigation.  Panelist will provide an overview of antitrust under President Biden while detailing the implications of pending legislation, the meaning of recent enforcement actions, the increasingly aggressive posture of federal agencies, and legal developments in court.

Layne E. Kruse

Layne Kruse is a trial partner for antitrust and other complex business litigation.  Layne is the former Head of Antitrust and Competition, United States and previously served on the Global Supervisory Board. 

He concentrates on antitrust and business litigation, government investigations and regulatory matters, international disputes and other business problems. He has represented clients in petroleum production and marketing, health care, pharmaceuticals, medical devices, insurance, publishing, consumer products, transportation and other industries. 

Layne has been named a BTI Client Service All Star in the US based on a survey of corporate counsel.  Certified in Civil Trial Law by the Texas Board of Legal Specialization, Chambers USA states that he is a "very skilled courtroom advocate who knows the law, but also has a manner that connects with local judges and juries."

Layne has been a first-chair litigator for jury trials, nationwide class actions, injunctions, arbitrations and appeals, representing both plaintiffs and defendants. He has appeared in courts throughout the United States from Florida to Alaska, from Hawaii to New York, and from California to the District of Columbia. Layne is a former judicial clerk to the Chief Judge, US Court of Appeals for the Fifth Circuit.

Jeffrey S. Oliver

Jeffrey Oliver is a Partner in the firm's Antitrust and Competition Practice. Mr. Oliver advises clients on all aspects of antitrust law, with an emphasis on U.S. and international merger reviews. Mr. Oliver has obtained antitrust clearance for transactions in a wide variety of industries and jurisdictions, with significant experience in oil and gas, healthcare, heavy industry, utilities, chemicals, media, transportation and trade associations. His practice routinely involves substantive advocacy in the U.S., China, Germany, Austria, Australia, before the E.C. and in other jurisdictions.

Prior to joining Baker Botts, Mr. Oliver was a Staff Attorney at the Federal Trade Commission, Bureau of Competition. There, Mr. Oliver’s practice focused on merger and conduct investigations in the oil and gas industry. Mr. Oliver has experience in all phases of the FTC and DOJ investigation processes, from reviewing HSR filings to challenging mergers in litigation.

Geraldine handles complex antitrust, RICO, and class action litigation in federal and state courts. She has obtained a number of dismissals and other favorable outcomes for her clients. She has also represented clients in private arbitration and secured success for her clients there. She has advocated for clients in pre-litigation contract, antitrust, and other commercial disputes, achieving good results and avoiding litigation. With her knowledge of the substantive law, she also counsels and develops relationships with clients on antitrust and other compliance matters.

Geraldine provides detailed, forward-thinking analysis and practical, business-ready advice. She makes sure her clients are in the best position to prosecute or defend against ongoing or anticipated litigation.

MCLE Credit

Texas Course Number 174165774. This course has been approved for Minimum Continuing Legal Education credit by the State Bar of Texas Committee on MCLE in the amount of 1.0 credit hours, of which no credit hours will apply to ethics/professional responsibility credit.

This online program has not been approved for MCLE credit in any other jurisdictions. If requested by attendees, CAIL will request accreditation in California, Louisiana, New Mexico, Ohio, Oklahoma, Pennsylvania and West Virginia.
