Overview

Russia’s invasion of Ukraine has changed the world in fundamental ways in even a very short period of time.  International legal proceedings against the Russian Federation are currently pending including an international criminal investigation before the International Criminal Court and a case before International Court of Justice alleging violations by the Russian Federation of the Genocide Convention instituted by Ukraine.  Further, sanctions have targeted key Russian interests, including energy interests.  The certification of the Nord Stream 2 pipeline has been put on hold by the German government in response to Russian action.  Similarly, international energy companies have indicated their exit from or intent not to further invest in Russian energy projects. At the same time, Russian-Chinese energy projects continue to go forward and may even accelerate.  This panel will provide a briefing of these late breaking issues and will provide a context against which to understand these developments. It will set out what to make of the currently pending legal proceedings and will discuss future potential legal proceedings by the Russian Federation or Russian nationals. It will also ask what (energy) world we are waking up to as Europe continues its attempt to decouple from Russia and China appears poised to deepen its energy cooperation with the Russian Federation.

Speakers

Prof. Dr. Danae Azaria is an Associate Professor in the Faculty of Laws at University College London.  Prof. Dr. Azaria is one of the world’s leading expert on energy transit law. Her 2015 book, “Treaties on Transit of Energy via Pipelines and Countermeasures” (Oxford University Press) received the 2016 Paul Guggenheim Prize.  Prof. Dr. Azaria is currently the Principal Investigator of State Silence funded by a European Research Council Grant.  She is a frequent commentator on energy arbitrations and has significant expertise on the law of treaties, the law of state responsibility and international energy law.  

Prof. Dr. Leila N. Sadat is the James Carr Professor of International Criminal Law at Washington University in St. Louis School of Law and currently serves as Special Adviser on Crimes Against Humanity to the ICC Prosecutor.  Prof. Dr. Sadat is one of the world’s foremost authorities in the fields of public international law, international criminal law, human rights, and foreign affairs, having published more than 160 books and articles in leading journals, academic presses, and media outlets throughout the world.  She received  Washington University’s Arthur Holly Compton Distinguished Faculty Award  in recognition of her leadership of the Crimes Against Humanity Initiative, a ground-breaking project to write the world’s first treaty on crimes against humanity. She is the current President of the International Law Association (American  Branch), Chair-Elect of the AALS Section on International Law, and a member of the American Law Institute and the U.S. Council on Foreign Relations. She is currently a Senior Research Scholar at Yale Law School.

Prof. Frederic G. Sourgens is the Senator Robert J. Dole Distinguished Professor of Law at Washburn University School of Law.  Prof. Sourgens serves on the Executive Committee of the Institute for Energy Law, as well as on the Executive Council of the American Society of International Law.  Prof. Sourgens has authored nearly 100 books, articles, book chapters, essays, and other contributions in leading journals, academic presses, and media outlets.  

Prof. Harry W. Sullivan Jr. is is an International Energy Attorney based in Dallas, Texas, where he is an Executive Professor at Texas A&M School of Law and an Adjunct Professor at SMU’s Dedman School of Law and works as Assistant General Counsel for Kosmos Energy in their West Africa exploration activities. His previous experience includes fourteen years as Senior Counsel-International in the International E&P Legal Group of ConocoPhillips, Of Counsel with Thompson & Knight LLP, fifteen years as Chief Counsel-International and Senior Counsel for Atlantic Richfield Company and five years as Senior Counsel for Sun Oil Company. His practice and experience focuses on the upstream and mid-stream oil and gas industry, both in the U.S.A. and internationally, in more than 25 different countries. He has extensive experience in international gas and LNG projects.

Baiju Vasani is a Senior Fellow at the School of Oriental and African Studies (University of London) School of Law. Over the last two decades, Baiju Vasani has served as lead trial counsel and arbitrator in international arbitrations across a range of sectors and industries involving ICSID, ICC, LCIA, ICDR, SIAC, UNCITRAL, BITs, the Energy Charter Treaty, and public international law. He has also advised states on negotiating and drafting investment treaties, and investors on (re)structuring their investments for maximum treaty protection consonant with tax and corporate governance strategies. He is a Fellow of the Chartered Institute of Arbitrators, and on the arbitration panels of various institutions worldwide, including ICSID. He has previously served as an Adjunct Professor of Law at Georgetown University, USA, and has regularly been ranked by his peers for expertise in international arbitration by Best Lawyers in America, Chambers USA, Chambers UK, Who’s Who of International Commercial Arbitration, Legal 500, Guide to the World’s Experts in Commercial Arbitration, and Reuters’ Super Lawyers. He has in the past represented the Russian Federation in international investment disputes.
