This online conference, hosted by IEL’s Young Energy Professionals Committee, features sessions on the midstream sector of the industry. The conference is primarily designed for attorneys and professionals in their first ten years of practice but may also be of interest to individuals looking to learn more about the midstream sector.

The panelists will set out the landscape of government regulation of midstream pipelines at the federal and state levels. The panel will cover Federal Energy Regulatory Commission and State commission regulation of natural gas, oil, and liquids pipelines. Regulation of rates and terms and conditions of service, as well as infrastructure permitting, will be discussed, with a focus on highlighting the regional difference in midstream regulation in Texas and Louisiana, the Marcellus and Utica shales, and New England. The panel will also discuss current hot-button issues and the look ahead for 2023.

This presentation will explore key provisions in gathering agreements involving the transportation of commodities from receipt points located near a producer’s wellhead to processing, storage, disposal, or other similar facilities. The session will cover common issues related to dedication language, covenants running with the land, release rights and other remedies, as well as other matters dealing with typical provisions to address operational issues leading to capacity constraints.

The United States contains a vast network of pipelines transporting natural gas, crude oil and other commodities that are integral to the U.S. energy supply and other critical infrastructure sectors. With the increased reliance on technology to operate these critical pipelines, the risk of malicious actors exploiting vulnerabilities to these systems is heightened. This discussion will focus on the current and developing regulatory landscape for pipeline cybersecurity.

Texas Course ID Number: 174182004. This course has been approved for Minimum Continuing Legal Education credit by the State Bar of Texas Committee on MCLE in the amount of 5.75 credit hours, of which no credit hours will apply to ethics/professional responsibility credit.

For this conference, IEL will also apply for course accreditation in the following states: California, Colorado, Kansas, Louisiana, New Mexico, Ohio, Oklahoma, Pennsylvania, Virginia and West Virginia. Some of these states may not approve a program for credit hours before the program occurs.

Attorneys may be eligible to receive CLE credit through reciprocity or attorney self-submission in other states.
